
Terms & Conditions for Photography Services
A non-refundable deposit of 20% is payable upon booking. The remaining balance is due within one week of receiving the final invoice. Cash or direct debit will be the only accepted forms of payment.
If the Client needs to reschedule their session, MountainTop Films will accommodate the change only if the new date does not conflict with existing bookings. The priority for rescheduling will be based on the availability of the photographer.
The Client may not downsize to a smaller package after they have paid a deposit for that package. However, they may upgrade to a larger package at any time provided that MountainTop Films is available for the upgraded package on the desired date and can accommodate the additional workload.
MountainTop Films will be the exclusive professional photographer. Friends and family are permitted to operate cameras on the condition that they do not interfere with or get in the way of the professional coverage.
The Client and its agent’s, family members and assignees, if any, shall indemnify, and hold harmless, MountainTop Films and its employees from any and all claims for damages arising out of the performance of any of the services contemplated by this Agreement with the exception of intentional or illegal acts.
MountainTop Films reserves the right to terminate this contract at any time for any reasonable cause, such as accident or ill health. In such an event, MountainTop Films will make reasonable efforts to find a replacement photographer. If a suitable replacement cannot be found or if the Client prefers not to proceed with a replacement, all monies paid up to that point will be refunded in full.
In the event of an emergency, equipment failure, or other unforeseen circumstances, MountainTop Films will return any payments made up to that point but will not assume any further liability.
MountainTop Films will not be held liable for any production issues beyond their control, including but not limited to bad weather, accidents, poor lighting, interference from external parties, or other unforeseen circumstances.
MountainTop Films is not responsible for any missing, damaged or altered clothing or material belonging to the Client. Please be aware that due to the movement-based nature of the prompts suggested during the shoot, the client should anticipate shifts in their appearance and they may get dirty. It is ultimately the Client’s responsibility to make sure their clothes, makeup, hair and overall appearance are the way they want for the photos. MountainTop Films is not liable for any issues related to the Client’s physical appearance as their responsibility is limited to directing and photographing the Client.
Deliverable items are contingent upon the Client’s actions. MountainTop Films is not liable for any compromise in agreed-upon items due to the Client’s neglect. The photographer is not responsible for photographs not taken due to the Client’s failure to provide reasonable assistance or cooperation.
The Client is obtaining photos for personal use only and shall not sell said photos. The Client is permitted to share photos with vendors having their products or setups photographed, provided that the vendors credit MountainTop Films for any photos posted online. No commercial use is granted by the issuance of print or digital photos without explicit written permission from MountainTop Films.
By choosing MountainTop Films, the Client acknowledges and accepts the style of shooting, editing, and colour choices used by the photographer. The Client agrees to allow MountainTop Films full discretion in making all final decisions regarding these creative aspects.
Basic retouching includes editing colours and removing obvious blemishes. Basic retouching does not include changes such as altering body shapes, fixing clothing or makeup issues, removing people or objects from a photo, or adding elements to a photo.
All outtakes and unedited photos are the property of MountainTop Films. Clients may choose to purchase the unedited photographs from the shoot for an additional $1000 however, the Client agrees that all unedited photos are not permitted to be shared, distributed or posted under any circumstances. Only retouched photos will be released.
If the Client requests any additional editing beyond the agreed upon scope of work, including but not limited to advanced retouching or editing extra photos, a fee of $50 per hour of editing will apply.
CD/DVD’s are not available through MountainTop Films. All files will ordinarily be sent digitally through an online photo gallery.
Upon taking possession of the finished product, the Client must inform MountainTop Films of any technical or other problems with the photos within 7 days. After 7 days, if no notification has been received, the Client will be deemed satisfied with the product.
If the Client is not satisfied with their photos, they may be eligible for a partial refund of 50% of the total package price if the issue stems on the photographer’s end. MountainTop Films is granted 1 attempt to re- edit the photos to the Client’s satisfaction. A partial refund will be considered only if the photographer has attempted and failed to resolve the issue and determines that a refund is appropriate.
If the Client requests a re-shoot of their photos for any reason, it will be treated as a new session, and the Client will be required to purchase a new package.
To maintain organization and conserve space, photos may be deleted or become unavailable 90 days after the Client’s session has taken place. The Client agrees to waive any and all claims against MountainTop Films for the unavailability of such photos after this period, even if replacement is sought at the Client’s own expense. Therefore, it is strongly advised that the Client back up their photos to multiple storage locations to prevent any potential loss.
By booking, the parties agree that they fully understand and will be bound only by the terms above. Any other terms must be agreed to in writing. Otherwise, the above terms will be considered the consolidated, exclusive terms between the parties.
